Terms of Use

1. Agreement to Terms

By accessing or using SmileJourney ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and APPS FOR DENTISTS, MCHJ ("Company", "we", "us", or "our").

2. Eligibility

You must be at least 13 years of age to use SmileJourney. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent that you meet these eligibility requirements.

3. Description of Service

SmileJourney is a personal orthodontic progress companion app. It is not a medical device, diagnostic tool, or substitute for professional dental advice. The App provides:

  • Guided photo sessions for tracking clear aligner treatment progress
  • Daily aligner wear time tracking with Live Activities
  • Tray journey timeline and treatment organization
  • Notes, symptom journaling, and weekly check-ins
  • Before/after photo comparison and cinematic time-lapse exports
  • Smart insights and treatment reminders
  • Optional iCloud synchronization across Apple devices

4. Medical Disclaimer

SmileJourney is for personal tracking and motivational purposes only. The App does not provide medical advice, diagnosis, or treatment recommendations. Always consult your orthodontist or dental professional for treatment decisions. We are not responsible for any treatment outcomes or decisions made based on information displayed in the App.

5. User Accounts

You may create an account using Apple Sign-In. You are responsible for maintaining the security of your account credentials and for all activities under your account. You agree to provide accurate information and to update it as needed.

6. Subscriptions and Payments

SmileJourney offers both free and premium features. Premium features are available through subscription plans (weekly, yearly) or a one-time lifetime purchase.

  • All payments are processed through the Apple App Store.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel subscriptions through your Apple ID settings.
  • We do not collect or store your payment information.

7. User Content

You retain all rights to content you create within the App, including photos, notes, and treatment data. By using the App, you grant us a limited license to store and process your content solely for the purpose of providing the service. Your content remains on your device unless you enable iCloud Sync.

You agree not to use the App to store or transmit any content that is illegal, harmful, threatening, abusive, or otherwise objectionable.

8. Intellectual Property

The SmileJourney name, logo, design, and all related intellectual property are owned by the Company. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or reverse-engineer the App.

9. Third-Party Services

SmileJourney integrates with the following third-party services:

  • Apple iCloud / CloudKit: For optional data synchronization across devices.
  • Apple Sign-In: For account authentication.
  • TelemetryDeck: For privacy-first, anonymized analytics.

We are not responsible for the operation, availability, or policies of third-party services.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PRECEDING 12 MONTHS OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, losses, or expenses arising from your use of the App, your content, or your violation of these Terms.

14. Termination

You may delete your account at any time from within the App. We may suspend or terminate your access if you violate these Terms or engage in conduct that may harm the Company or other users. Upon termination, your right to use the App ceases immediately.

15. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through good-faith informal negotiation. If resolution cannot be reached, disputes shall be settled through binding arbitration in accordance with applicable arbitration rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan, without regard to conflict of law principles.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

18. Apple App Store Requirements

You acknowledge that these Terms are between you and the Company, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the App and supersede all prior agreements.
